This end user license agreement (“EULA”) is a legal agreement between you (“User”) and Joseph Töreki. By downloading, purchasing, or using any assets from Joseph Töreki (including but not limited to textures, 3D models, and videos, collectively referred to as “assets” or “content”), you agree to the terms below.
1. License Grant
Joseph Töreki grants you a non-exclusive, worldwide license to use the assets under the following terms:
- You may use the assets in unlimited projects, without additional licensing fees, indefinitely.
- You may use the assets across all media, including personal, educational, and commercial projects.
- This license does not grant ownership of the assets; all rights remain with Joseph Töreki.
2. Restrictions
You may not:
- Use the assets as a logo, trademark, or service mark.
- Sell, share, sublicense, or redistribute the assets as standalone files or in any way that would compete with Joseph Töreki.
- Use the assets in illegal, defamatory, or harmful projects.
- Claim, suggest, or imply that you are the original creator of the assets.
- Include the assets in commercial asset collections, resale packs, or bundles for distribution.
3. Ownership
All assets remain the intellectual property of Joseph Töreki. This license grants usage rights only; it does not transfer copyright, trademark, or other ownership rights.
4. Warranty Disclaimer
The assets are provided “as is” without warranties of any kind, either express or implied. Joseph Töreki does not guarantee that the assets are error-free, complete, or suitable for your specific project.
In no event shall Joseph Töreki be liable for any direct, indirect, incidental, consequential, or special damages arising from the use of the assets.
5. Termination
This license will terminate automatically if you violate any of its terms. Upon termination, you must immediately delete all copies of the assets. All rights granted to you under this license will cease upon termination.
6. Governing Law
This EULA shall be governed by and construed in accordance with the laws of the Republic of Austria. Any disputes arising under this EULA shall be subject to the exclusive jurisdiction of the courts in Vienna, Austria.
For users outside Austria, international courts may only have subsidiary jurisdiction, and Austrian law shall remain the primary governing law.
This EULA does not affect statutory consumer rights where applicable. In cases where local consumer protection laws provide additional rights, those rights may apply to users outside Austria.
7. Severability
If any provision of this EULA is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
8. Refunds and Withdrawal
All sales of digital assets are final. By purchasing or downloading digital content, you acknowledge that you waive any statutory right of withdrawal for immediate digital delivery, where applicable.
For users outside the European Union, local consumer protection laws may apply, but unless otherwise required by law, all purchases are non-refundable.
